AG Derek Schmidt: Kansans eligible to receive $2.3 million from Fiat Chrysler settlement for consumer protection violations

TOPEKA – (March 6, 2019) – More than 1,000 Kansas consumers who purchased or leased Jeep or Dodge model vehicles with 3.0-liter V6 diesel engines are eligible to receive an estimated $2.3 million from Fiat Chrysler as a part of a legal settlement with the State of Kansas, Attorney General Derek Schmidt announced today.

The settlement with Kansas, together with related settlements with the federal government and other states, resolves consumer protection claims brought against the car manufacturer by Schmidt, the attorneys general of 51 other states and territories and several other state environmental enforcement agencies. The company was accused of violating state laws prohibiting deceptive or unconscionable acts and practices by marketing, selling and leasing diesel vehicles equipped with illegal and undisclosed emissions defeat-device software.

“When purchasing a new car, Kansans deserve to have honest information,” Schmidt said. “This settlement will enable Kansans who were deceived to have their vehicles modified to meet the appropriate emissions standards and to receive restitution from Fiat Chrysler for its dishonest claims.”

Under the settlements, Fiat Chrysler is required to implement a restitution program for more than 100,000 owners and lessees of 3.0-liter diesel vehicles of the model year 2014 through 2016 listed in the chart below at a maximum cost of approximately $307 million. This includes more than 1,000 vehicles in Kansas.

Under the program, owners will be eligible to receive a restitution payment between $2,460 and $3,075. Lessees, former owners, and former lessees will be eligible to receive a restitution payment of $990. This monetary relief is in addition to an option to have their vehicle modified to correct the problem.

Affected consumers will be sent notice by U.S. mail from Fiat Chrysler and should visit https://www.ecodieselsettlement.com/ or call 1-833-280-4748 to determine their eligibility for restitution, the emissions fix, and an extended warranty and to access the claim submission form. Deadlines apply, so claims should be made immediately.

Fiat Chrysler also will pay the cost of the state's investigation in this case.
