AG Derek Schmidt statement on resolution of ‘vote anywhere’ lawsuit

TOPEKA – (July 28, 2020) – Kansas Attorney General Derek Schmidt issued the following statement on today’s decision by Shawnee County District Judge Thomas Luedke to dismiss a lawsuit filed by the Kansas Democratic Party and three national Democratic Party organizations against the Kansas Secretary of State. The court concluded that the Secretary of State’s implementation of a 2019 law authorizing local election officials to cast their ballots at any voting location in the county did not violate state law or impose a burden on the right to vote:

“I welcome the court's decision to dismiss, which confirms this lawsuit was about partisan politics, not about the law."

The case is Kansas Democratic Party, et al. v. Schwab, No. 2020-CV-000127.
