Douglas County landscaper ordered to repay more than $8,000 to consumers

LAWRENCE – (June 8, 2016) – A Douglas County landscaper was ordered this week to repay two Kansas consumers, settling allegations that he violated the Kansas Consumer Protection Act, Attorney General Derek Schmidt said.

Dreamscapes Landscape & Irrigation, Inc., Eudora, and its owner, Paul B. Gardner, II, were ordered Monday in a consent judgment to pay restitution of $8,342.33. In addition, the company was ordered to repay the attorney general’s office for the costs of the investigation and refrain from further violations of the Consumer Protection Act.

An investigation by the attorney general’s Consumer Protection Division found that Gardner misrepresented his work, by saying that work would be done by a specified time and failing to meet that obligation, and accepted down payments from consumers then failed to perform the work. Gardner did not admit any wrongdoing, but did agree to the terms of the consent agreement.

The order was approved Monday by Judge B. Kay Huff in Douglas County District Court.
