AG Schmidt: AT&T Mobility customers in Kansas eligible for refunds under national settlement

Release Date: Oct 10, 2014

TOPEKA – (October 10, 2014) – AT&T Mobility customers in Kansas who were charged for third-party services on their mobile phone bills without their consent are eligible to receive refunds as part of a multi-state settlement reached earlier this week, Kansas Attorney General Derek Schmidt said today.

The national settlement announced Wednesday was reached between AT&T Mobility, the attorneys general of Kansas and 48 other states and the District of Columbia, the Federal Trade Commission and the Federal Communications Commission includes a total payment of $105 million to resolve allegations that AT&T Mobility placed charges on consumers’ mobile phone bills for third-party services that had not been authorized by the consumer, a practice known as “mobile cramming.”

Under the terms of the settlement, AT&T Mobility is required to provide $80 million in funds to be used to pay refunds to consumers who were victims of cramming.  The fund will be administered by the Federal Trade Commission.

“Consumers have a right to be clearly informed about the services they are purchasing – and the cost,” Schmidt said. “This settlement returns to consumers charges for programs they didn’t know they were signing up for and were often unable to cancel.”

To obtain a refund, eligible Kansas consumers should submit claims under the AT&T Mobility cramming refund program by visiting www.ftc.gov/att . On that website, consumers can find information about how to obtain a refund.  If consumers are uncertain about whether they are eligible for a refund, they can visit the claims website or contact the Claims Administrator at 877-819-9692 for additional information.

Consumers with concerns about questionable sales or marketing practices can contact the Kansas Attorney General’s Consumer Protection Division at 1-800-432-2310 or visit www.InYourCornerKansas.org  for more information.
