TOPEKA – (May 9, 2014) – A lawsuit filed by Planned Parenthood against a state law that reprioritizes the use of federal family planning funds was dismissed today, Kansas Attorney General Derek Schmidt said.
Schmidt’s office has been defending the law, enacted by the Legislature in 2011, against a legal challenge filed that same year. The plaintiffs initially persuaded a federal judge in Kansas to enter an injunction blocking the new law, but the 10th U.S. Circuit Court of Appeals in Denver recently lifted the injunction. After the appeals court ruled in favor of the State, the plaintiffs agreed to dismiss the lawsuit with prejudice, which means it cannot be refiled.
“We take seriously our duty to defend Kansas law against legal challenges,” Schmidt said. “This law was successfully defended.”
The case dismissed today was Planned Parenthood of Kansas and Mid-Missouri v. Brownback et. al.
