AG Schmidt: ACLU lawsuit dismissed

TOPEKA – (January 23, 2013) – A federal judge today dismissed a lawsuit challenging a Kansas law that regulates insurance coverage for abortions, Kansas Attorney General Derek Schmidt said.

District Judge Julie Robinson today ordered dismissal of the lawsuit, which was filed by the American Civil Liberties Union (ACLU) against Insurance Commissioner Sandy Praeger. The dismissal comes weeks after Judge Robinson ruled against part of the ACLU’s claims and ordered a trial on the remainder. The ACLU and the attorney general’s office last week agreed to dismiss the case with prejudice, meaning it cannot be refiled.

The lawsuit was challenging the constitutionality of a statute enacted by the Legislature in 2011. The statute will now remain in force.
